Holidays at 18. Explanations on working hours

The production calendar for 2018 shows the norm of working hours for months, quarters and 2018 as a whole for 40-, 36- and 24-hour work weeks, as well as the number of working days and days off for a five-day work week with two days off.

According to Article 112 of the Labor Code Russian Federation (hereinafter referred to as the Labor Code of the Russian Federation) (as amended by Federal Law No. 35-FZ dated 23.04.12) non-working holidays in the Russian Federation are:

  • January 1, 2, 3, 4, 5, 6 and 8 - New Year's holidays;
  • January 7 - Nativity of Christ;
  • February 23 - Defender of the Fatherland Day;
  • March 8 - International Women's Day;
  • May 1 - Spring and Labor Day;
  • May 9 - Victory Day;
  • June 12 - Day of Russia;
  • November 4 - National Unity Day.

The Labor Code of the Russian Federation established that if a day off and a non-working holiday coincide, the day off is transferred to the next working day after the holiday. Thus, weekends are postponed in 2018:

  • sunday 4th November to Monday 5th November.

The exception is weekends coinciding with non-working holidays in January. In accordance with Art. 112 of the Labor Code of the Russian Federation The Government of the Russian Federation has the right to postpone two days off from the number of days off that coincide with non-working January holidays to other days in the next calendar year. In addition, part 5 of this article allows the Government of the Russian Federation to postpone weekends to other days in order to rationally use weekends and other non-working days.

Decree of the Government of the Russian Federation of October 14, 2017 No. 1250 provides for the transfer of days off in 2018:

  • from Saturday 6 January on Friday 9 March;
  • from Sunday 7 January to Wednesday 2 May;
  • from Saturday 28 April to Monday 30 April;
  • from Saturday 9 June to Monday 11 June;
  • from Saturday 29 December to Monday 31 December.

In accordance with the "Procedure for calculating the norm of working time for certain calendar periods of time (month, quarter, year), depending on the established duration of working time per week," approved by order of the Ministry of Health and Social Development of Russia dated 13.08.09 No. 588n, this norm is calculated according to the calculated five-day schedule working week with two days off on Saturday and Sunday, based on the duration of daily work (shift):

  • with a 40-hour work week - 8 hours;
  • with a 36-hour work week - 7.2 hours;
  • with a 24-hour work week - 4.8 hours.

The duration of a working day or shift immediately preceding a non-working holiday shall be reduced by one hour. Moreover, if a day off is postponed to such a working day, then the day off, which becomes a working day, is reduced by 1 hour. In 2018, working hours are reduced by one hour on the following days:

  • February 22;
  • March 7;
  • April 28;
  • May 8;
  • the 9th of June;
  • December 29th.

The working time norm calculated in the indicated order applies to all modes of work and rest.

An example of calculating the norm of working hours in December 2018 with a five-day working week with two days off (initial data: 21 working days, on December 29 the working day was reduced by 1 hour):

  • calculation for a 40-hour work week:
    (8 hours x 21 days) - 1 hour = 167 hours;

  • (7.2 hours x 21 days) - 1 hour = 150.2 hours;

  • (4.8 hours x 21 days) - 1 hour = 99.8 hours.

In 2018, 247 working days, including 6 working days reduced by one hour. Calculation of the norm of working hours for 2018 with a five-day working week with two days off:

  • with a 40-hour work week:
    (8 hours x 247 days - 6 hours) = 1970 hours;
  • with a 36-hour work week:
    (7.2 hours x 247 days - 6 hours) = 1772.4 hours;
  • with a 24-hour work week:
    (4.8 hours x 247 days - 6 hours) = 1179.6 hours.

The production calendar of Russia for 2018 contains information on how many working days in a year, how Russians rest, how many days the New Year holidays, May holidays last, as well as the transfer of weekends and non-working holidays. It provides the norms of working hours by months, quarters, semesters and in general for the year with a 40-, 36- and 24-hour five-day working week.

Production calendar (PC) - This is an unofficial document that, taking into account the norms of legislation, facilitates the regulation and accounting of working hours in the current year. In 2018, the main legal and accounting portals published 2 types of PCs: for 5-day and 6-day working weeks. Every year, the procedure for drawing up a PC is tacitly based on the norms of the Ministry of Health and Social Development of the Russian Federation.

The production calendar is implemented in all modern systems accounting.

The PC can be used in both paper and electronic format. The second is preferable, because:

  • many services have a pre-notification function, and a calendar user will never miss holidays and their periods, as well as official transfers;
  • facilitates the computing part thanks to the built-in working time calculators

Clarifications on working hours

Art. Art. 91 and 92 of the Labor Code of the Russian Federation, the working hours are normalized for certain categories of workers:

  • generally accepted - 40-hour work week;
  • for employees of the enterprise under 16 years old - up to 24 hours / week;
  • from 16 to 18 years old - up to 35 h / week;
  • for disabled people of 1 and 2 degrees - up to 35 h / week;
  • for workers in hazardous and heavy industries - up to 36 hours / week.

There are also special modes for students and part-time workers. According to the Labor Code of the Russian Federation and the order of the Ministry of Health and Social Development No. 588n of 13.08.09, any company can collectively establish a different working time, which cannot exceed the maximum established by the Labor Code.

Important!

  • In organizations with summarized accounting of time for periods equal to a month or a year or another period of time, their daily, weekly and monthly rate is calculated based on the work period norm established in the Labor Code of the Russian Federation.
  • In case of cumulative overtime accounting, work on holidays and weekends included in this period will not be recognized. Processing over the time period is recognized as such.
  • So, if the period is the 3rd quarter of 2018, then the norm will be 520 hours. This means that the hours worked from 521 hours are considered overtime.
  • It should be noted that there will be no violation of the Labor Code of the Russian Federation in this case, since payment for work on holidays / weekends will have to be doubled.

But in any case, the daily rate is calculated from the standard assumption of the length of the week - 5/2. Even if the organization is for 6 days. The rate is calculated by dividing the weekly time by 5:

  • 40 hours / 5 = 8 hours
  • 36h / 5 = 7.2 h.
  • 24 hours / 5 = 4.8 hours.
  • Etc.

The standard version of the production calendar takes into account all the working hours provided for by the Labor Code of the Russian Federation. The accountant can only find out the category of the employee in order to calculate his salary.

The monthly rate (MN) is calculated based on the daily rate (DN):

DN * number of working days in a month = MN,

if a decrease in the working day is expected in a month due to a subsequent holiday, then the number of hours of decrease is subtracted from the IN.

For example, the monthly working hours in November 2018 for a 5-day (40-hour) week:

(40h. / 5) * 21 = 8 * 21 = 168 hours.

The annual rate of working hours is calculated using the formula:

DN * number of working days in a year - hours of "decrease".

Holidays and shortened days according to the calendar

So, what holidays await us in 2018 and what days will be shortened before these holidays we will tell you in detail below.

Holidays

So, the list of official non-working holidays at the federal level is given in Article 112 of the Labor Code.

But Russia is a multi-confessional country, and its citizens may have different holidays. Therefore, Art. 6 of the Labor Code of the Russian Federation and Article 4 of the Federal Law “On Freedom of Conscience on Religious Associations” stipulate that the authorities of the constituent entities of the Russian Federation can declare holidays and other days, taking into account local traditions and beliefs. So, for example, in the Republic of Tatarstan these are: June 25, August 30, September 1. A subject's holidays are included in the subject's PC and affect the working hours.

Holiday-weekend

Part 2 of Article 112 states: if the holiday falls on a non-working Saturday or Sunday, then instead of this day off, another day of rest is provided - the next working day. This rule is valid for all time except New Year's holidays. So, November 4, 2018, National Unity Day, is Sunday, so November 3, 4 and 5 will be days off.

In accordance with article 113, it is prohibited to involve employees in work on holidays. This is easy to remember when using a PC: dates are highlighted and when you hover the arrows over them, pop-up tips - warnings appear.

Shortening the working day before the holiday

In addition to holidays, the calendar also marks pre-holiday days with a note on the obligation to reduce the working day by one hour (according to Article 95 of the Labor Code). The "smart" PC will also take into account the days of transferring holidays from weekends to weekdays.

Rescheduling the weekend in 2018

There are many holidays in the Russian Federation and sometimes these days are not very convenient for citizens. In order to optimize the rest time, the legislator, in the same article 6 of the Labor Code of the Russian Federation, provided for the possibility of transferring holidays to other days. It is issued by the annual Government Decree. No more than 2 days can be postponed from New Year's holidays, which has been done for several years in a row.

In 2018, the transfers will be as follows:

  • Saturday 6th January - Friday 9th March
  • Sunday 7 January - Wednesday 2 May
  • Saturday 28 April - Monday 30 April
  • Saturday 9 June - Monday 11 June
  • Saturday December 29 - Monday December 31

All the transfers became officially known in the fall of 2017, but nevertheless, adjustments are still possible, keep this in mind.

A few more words about the calendar

What data can be seen on the production calendar

PC is an unofficial document, its introduction and use is not regulated by law. However, in essence, the PC is a reflection of some articles of the laws on a regular calendar.

In addition to, in fact, the usual calendar with notes on work, weekends and holidays (official and national) days, the PC includes:

  • tables with calculated norms of working / non-working hours by months and quarters,
  • numerical information on the number of workers and days off in each reporting period (from month to year),
  • information about the postponement of holidays and about reducing the length of the working day before them.

Who needs a calendar

The working population of the Russian Federation almost always turns to a PC when planning a vacation.

Accountants use a PC to calculate disability benefits, vacation pay, and wages. Full accrual occurs when the norm of working hours in a month is fulfilled. A proportional charge will be made in the case when an employee has not worked for the entire month.

In "gray" companies, PCs are used by personnel officers, who are usually responsible for calculating part of the salary "in envelopes". They also draw up work and shift schedules on its basis, count the number of vacation days an employee is entitled to.

The rest of the population learns from the PC about professional and other holidays, weekends; uses other information.

The production calendar is irreplaceable for an accountant, therefore it should always be in sight.

Information assistants that facilitate the work of accounting and personnel are various calendars with dates for important tax and statistical reporting. One of these popular "reminders" was production calendar 2018. It is compiled annually. It is based on the Decree of the Government of the Russian Federation, which regulates the transfer of weekends during current year... It ensures the rational use of working days, weekends and holidays. A new legislative act on the distribution of days off in 2018 was issued on June 20, 2017.

From this day on, all services of the enterprise can plan vacation schedules, calculations of working hours, action plans for any period by month or quarter. But the standard working time is a five-day week: working days from Monday to Friday and two days off. Working hours range from 8 hours (normal) to 4.8 hours (shorter day). Accordingly, the working week can be 40, 36 and 24 hours.
The amount of working time is determined on the basis of the Procedure, which is approved by the order of the Ministry of Health and Social Development. The formula by which the rate is calculated is given in the above document. It is quite simple: the number of working hours per week, for example, 40 divided by 5, then the resulting number is multiplied by the number of working days in the month, and finally, we subtract the hours of reduced working days. But today the accounting department and personnel can forget even about these simple calculations. After all, the production calendar 2018 already contains the necessary numbers, comments and tips.

247 working days in 2018, 118 days off. The first quarter (January, February, March) of the year probably has the largest number of holidays - New Year and Christmas holidays in January.

  • The first month of the year begins with a vacation that all Russians are waiting for; they will last from December 30, 2017 to January 8, 2018. They also include the Nativity of Christ, the 7th. January 2018 has 17 work shifts, six days off and eight holidays.
  • February - Defender of the Fatherland Day, 23 February in the 18th year falls on a working day five day week... Therefore, the day preceding it, the 22nd, is a shortened pre-holiday day. That is, one of the days off will be "long", from 23 to 25 February.
  • In March, with holidays and weekends, 31 days are obtained. Twenty workers, ten days off and one public holiday.

Here the Government of the Russian Federation made a transfer saturday afternoon January 6th to Friday March 9th. As a result, we got a small spring break, because together with Saturday and Sunday there were four days of rest: 8, 9, 10, 11 March.

Second quarter

The next period is April, May, June. In it, state transfers affected all three months.

  • There are 30 days in April, 21 of them are workers, 9 are days off. The 28th day of the month is the pre-holiday day, according to part one of Article 95 of the Labor Code of the Russian Federation, shortened by one hour. It concerns the postponement - this Saturday has been moved to Monday, April 30. So there was a continuous, four-day rest period. The first holidays in May start on April 29 and last until May 2 inclusive.
  • In total, May contains twenty working days, 9 days off and two holidays - the Victory Day and the Spring and Labor Day. The second holiday in May falls in the middle of the working week. It was not affected by the transfers, so on May 8 it was shortened for one hour under the current labor legislation, and on May 9 (Wednesday) is a non-working holiday.
  • The June work schedule in year 18 consists of 20 work days, nine days off and the Day of Russia. This holiday, June 12, falls on Tuesday. Government Decree "On the transfer of days off" from 20.06.17. Saturday, June 9 turns to the closest Monday, June 11. The Russians are waiting for a working Saturday, and then the period of continuous rest includes June 10, 11, 12.

Third quarter

The third quarter of 18 is July, August and September. There are no holidays in these months, but the period is significant from the point of view of accounting and the work of the labor protection service.

  • In July, by the 27th, the accounting department submits an important report on the profit of the enterprise and organization and pays the tax of the same name.
  • Until August 1, the structures of the organization responsible for occupational safety submit to the FSS an action plan for labor protection to reimburse part of the costs that have already been made or are planned for implementation by the end of the year.
  • September, twenty working days and ten days off - the traditional start of business activity, more employees took regular annual vacations.

If during the vacation there were reviews and or leave for sick leave, it is possible to adjust its continuation, including being guided by the Decree of the Government of the Russian Federation on the transfer of days.

Fourth quarter

The last quarter of October, November and December includes one holiday, November 4th, National Unity Day.

  • October, as determined by the production calendar for 2018 with holidays, becomes the leader in the number of working days: there are 23 and eight days off.
  • November consists of 21 working days and 9 non-working days, including a public holiday. It falls on Sunday, which means, according to Article 112 of the Labor Code, it is postponed to a working day, Monday, November 5. The first weekend in November is getting longer - from Saturday, November 3, to Monday, November 5. For those businesses that operate on a six-day work week, Saturday will be a shortened pre-holiday day.
  • And in December, on the contrary, one of the Saturdays will be shortened, but working - December 29, the Government has postponed to December 31, ensuring the continuity of the rest period for Russians during the New Year holidays.

Briefly at the end of the year

The production date calendar for 18 years, approved by the government, does not contain fundamentally new legislative initiatives. Despite the bills submitted for consideration to the Duma to abolish the New Year holidays or to add their duration to the May holiday, it does not reflect anything like this. It can be downloaded here, in a convenient format with comments and necessary footnotes to print or simply save. The relevance of all the information in the calendar strictly complies with the regulatory documents.
